MOTORING CLAIMS
Who can claim for a motoring accident?
Accidents involving motor vehicles are the most common of all accident types with an estimated 50,000 accidents happening every month in the UK.
Motoring accidents can happen on roads, motorways, pedestrian crossings and pavements as well as on private land with work place vehicles.
Anybody who has been injured as a result of this type of accident can claim if it wasn't their fault. This includes non fault drivers and passengers of cars, busses, taxis, motorbikes and bicycles as well as pedestrians or any other road user.
MOTORING ACCIDENTS
Can I claim if I was partly to blame?
You may still be able to claim if you were partly at fault for the accident however, your compensation amount will be reduced to reflect your percentage of the blame.
Incidents which your insurer describes as "50 - 50" or "split liability" indicate that the fault of the accident has been split.
If you were held fully to blame, then unfortunately, you will not be able to make a claim for your injuries but your passengers still can.
MOTORING CLAIMS
Can I claim if I was in the fault vehicle?
Passengers in the fault vehicle are still able to claim for their injuries however, drivers in the fault vehicle - if fully responsible - are unable to claim for theirs.
Understanding the rules of the road is important when assessing where the blame lies in motoring accident circumstances. If you are unsure
MOTORING CLAIMS
Uninsured vehicle accident claims
Although motor insurance is a compulsory, legal requirement for vehicles on UK roads, some people still break the law and drive without having it in place.
Fortunately, the government has set up a fund within "The Motor Insurance Bureau" (MIB), which acts as a stand-in insurer for victims of uninsured vehicles
This means you are still able to claim for compensation even if you were injured by a somebody driving an uninsured vehicle accident.

YOUR RECOVERY MATTERS
Where needed, your solicitor will seek to recover funding for specialist treatments, including private surgery, as part of your injury claim.
This enables you to get private procedures which are otherwise unavailable or have long waiting times with the NHS.
Your requirements get assessed early on so parts of your rehabilitation can commence as soon as possible.
MOTORING CLAIMS
Hit and run accident claims
UK law states that it is compulsory to stop and exchange details at the scene of an accident. Unfortunately though, not all drivers do this and their victims are left injured and unsure of where to turn.
Thankfully, it is still possible to get compensated for your injuries and financial losses even when the fault driver was never found. In this instance, your claim gets directed to The Motor Insurance Bureau (MIB) who have a fund that compensates victims of untraced drivers in a similar way to a standard motor claim (where insurance details have been exchanged).
This means you are still able to claim for compensation even if the fault driver didn't stop at the scene.

Are there time limits to claiming for an injury?
In most instances, adults have 3 years to make a claim.
It is always advisable to start your claim as soon as reasonably possible. By doing this, you will ensure that your solicitor has plenty of time to navigate any set backs along the way and in turn, this will also increase your case prospects.
It is worth noting that some cases take longer than others to complete and, if left too long, you could potentially hinder your chances of success.
How long does it take to claim?
We usually know whether we can help you within one phone call.
If you are happy to go ahead, then your solicitors will commence work within 24 hours of receiving your authorisation.
The duration that your entire claim takes to complete is largely dependent on the complexity of your case and the severity of your injuries.
How much will I get?
Your compensation award covers your injuries and reimbursement for the financial losses that you have had, or that you are to have, as a result of the accident.
The amount you get directly correlates with the severity of your injury and the duration of suffering that you are expected to have.
The compensation that you get for your injury is known as general damages and the award you get for your financial costs and losses is known as special damages.
Who pays for my compensation?
In most instances, the defendant will have insurance that pays out in the event of an accident occurring.
It is their insurer that deals with your claim correspondence and pays for your compensation.
If you believe the person who was at fault didn't have insurance, it may still be possible to claim.
