EMPLOYERS LIABILITY CLAIMS

Work injury & illness

As an employee or subcontractor, injury and illness shouldn't ever "be a consequence of the job" that is expected as part of your employment.

It is the responsibility of the employer to ensure all employees and subcontractors have the appropriate training, equipment, environment and provisions to do their job safely and without suffering.

If you have been injured or experienced illness as a result of your job, then our team of experts will help in whatever way we can to ensure you get the most from your injury claim.

INJURY IN THE WORKPLACE

Who is at fault for my work accident?

In the majority of cases, accidents in the workplace are due to employer negligence or a colleague failing to follow health and safety rules.

If your injury or illness could have been avoided, then you may be able to claim compensation for your suffering, lost earnings and rehabilitation.

INJURY IN THE WORKPLACE

Accident caused by a colleague

A large proportion of work injury claims are caused by a colleague's actions. Their mistakes, short-cuts or carelessness could come from lack of training or simply "human error".

Either way, the actions of an employee are the assumed responsibility of your employer. This means that if your accident was caused by the fault of another worker, then your claim will be covered by the business insurance.

YOUR RECOVERY MATTERS

Where needed, physiotherapy and the funding of specialist treatments, including private surgery, are provided as part of your injury claim.

This often provides you with access to procedures that are otherwise unobtainable through the NHS.

Your requirements get assessed early on so your rehabilitation can commence as soon as possible.

Who pays for my work injury compensation?

Every business is legally required to have employers liability insurance in place when they employ a workforce. The insurance protects both the business and their employees in the even of an accident.

The claim process is fully handled by the insurance company and covers your employer for at least £5 million without risk of damaging the business.

Your rights as a temp worker

Unfortunately, the proper training of subcontracted, short term and temp staff are often is often not prioritised and gets overlooked by companies.

Even if you only work for a company for one day, you should be given all necessary training and safety equipment to do your job without it leading to an injury of yourself or others.

You are entitled to claim for your injuries and should not be negatively impacted as a result of your employment contract status.

INJURY IN THE WORKPLACE

Common causes of accidents

Workplace injuries can happen in hundreds of ways however, here are some of the most common causes of accidents that we find across all industries.

Trip, slip & fall accidents

Wet floors, leaks, icy floors, oil spillages and out of place objects are all hazards that can lead to injury. Your employer must ensure the grounds you are working on are clear and safe at all times

Manual handling injuries

Lifting heavy objects can cause injury when not done in the correct way. You should be trained properly in all areas of manual handling and not expected to lift heavy objects alone or in a rushed manner.

Faulty equipment

Regular maintenance and sufficient provisions of work equipment is a mandatory obligation of the employer. If your accident has been caused by old or broken equipment then it is likely you can claim.

Machinery accident

You should always be properly trained on any machinery used as part of your job. Machines should be safe and easy to function and there should be plenty of space for you to work without injury.

Falling from height

When working at height there should be sufficient safety barriers in place or alternatively, you should have safety harnesses and equipment to prevent you from falling.

Burns & electric shock

Burns and electric shock accidents should never happen at work. If you have suffered with such injuries, workplace Health and Safety measures are likely to have been breached and you should be able to claim.

PERSONAL INJURY

Personal injury FAQs

Are there time limits to claiming for an injury?

Adults over 18 years of age have 3 years to make a claim.

Minors under 18 years of age at the time of the accident, have until their 21st Birthday.

It is worth noting that some cases take longer than others to complete and, if left too long, you could potentially hinder your chances of success.

You should start your claim as soon as reasonably possible to ensure that there is time to navigate any set backs along the way.

How long does it take to claim?

We can usually tell whether we can help you within one phone call. If you are happy to go ahead, then we will follow your instructions and work will commence within 24 hours of receiving your authorisation.

The duration that your entire claim takes to complete is largely dependent on the complexity of your case and the severity of your injuries.

How to make an injury claim

How much compensation will I get?

Your compensation award covers your injuries and the financial losses that you have had as a result of the accident.

The amount you get directly correlates with the severity of your injury and the duration of suffering that you are expected to have.

The compensation that you get for your injury is known as general damages and the award you get for your financial costs and losses is known as special damages.

Who pays for my compensation?

In most instances, the person or business at fault for your accident will have a special type of insurance that pays out in the event of an accident occurring. For example, drivers have "motor insurance" and employers have "employers liability insurance".

It is their insurer that deals with your claim correspondence and pays for your compensation.

If you believe the person who caused your accident didn't have insurance, it may still be possible to claim. Find out more here.
